Terms of Service
1. Acceptance and eligibility
These Terms of Service ("Terms") are a legal agreement between you and Deeta LLC ("Deeta," "we," "us") governing your use of the Deeta app and the deeta.app website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
Minimum age (region-based) — no minors. Deeta has a region-based minimum age: you must be at least 13 in the United States, or at least 16 everywhere else (the EU digital-consent age under GDPR Art. 8, which we apply worldwide outside the U.S.; where your region is unclear, the higher floor applies). By using the Service you represent and warrant that you meet the minimum age for your region. Deeta is not directed to, and we do not knowingly permit use by, anyone below the applicable minimum age. During onboarding we ask for your date of birth and block anyone below that age. If you are under the age of majority where you live, you may use Deeta only with the involvement of a parent or legal guardian, who agrees to these Terms on your behalf. If we learn that someone below the applicable minimum age is using Deeta, we will terminate the account (see also the Privacy Policy, Children's Privacy).
2. The Service; personal, non-commercial use
Deeta helps you keep rich, structured information about the people in your life, with optional AI-assisted features and privacy-preserving sharing. We may add, change, or remove features over time. Some features require a paid subscription (Section 5).
Personal, non-commercial use only. Deeta is licensed to you for your personal, non-commercial use. You may not use the Service, its AI features, or any data it produces to operate a business, provide services to third parties, resell or sublicense access, build or train a competing or commercial product, or otherwise for any commercial purpose, except under a separate written agreement with Deeta.
3. Your account
You are responsible for your account credentials and for activity under your account. Keep your login secure and provide accurate information. Tell us promptly at contact@deeta.app if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Use the Service to violate any law or the rights of others.
- Upload or share content that is unlawful, harmful, or infringing.
- Attempt to breach, probe, or disrupt the Service, its security, or other users' data.
- Reverse-engineer, scrape, or build a competing product from the Service, except where that restriction is prohibited by law.
- Use automated means to access the Service, or use the AI features to generate abusive, deceptive, or high-volume automated workloads.
- Misuse the sharing features to harvest or redistribute other people's information.
We may suspend or terminate access for conduct that violates these Terms (Section 13).
5. Subscriptions and billing
Deeta offers paid subscription tiers (Plus, Pro, Power). Where you subscribe determines who processes your payment:
- Apple App Store: Apple is the merchant of record. Subscriptions are billed through your Apple ID and auto-renew until cancelled. Manage or cancel anytime in your Apple ID subscription settings; cancellation takes effect at the end of the current billing period.
- Web (Stripe): Stripe processes your payment. Subscriptions auto-renew until cancelled; cancelling stops future billing.
Renewal and price. Subscriptions renew automatically at the then-current price for your tier unless you cancel before the renewal date. We will give notice of a price change as required by the applicable app store or by law.
Refunds.
- Apple: refunds are handled by Apple and granted at Apple's discretion, per the App Store terms. Where Apple issues a refund, we revoke the corresponding entitlement.
- Web (Stripe): we do not provide refunds for service already consumed. Cancelling stops future billing. We may handle exceptional cases manually at our discretion.
Billing problems. If a renewal payment fails, we provide a short grace period (currently about 16 days on Apple and about two weeks on Stripe) during which you can update payment before access is affected.
Changing tiers. Upgrades take effect immediately (with proration where the platform supports it). Downgrades take effect at the end of the current billing period and are not refunded for the unused portion.
6. Fair use
Paid tiers are intended for personal, individual use. Each tier includes a monthly allowance of AI queries — higher tiers include substantially more, and the Power tier's allowance is effectively unlimited for ordinary personal use. Your tier's allowance is shown where you subscribe. This is subject to a fair-use policy: to protect the Service against abuse, automated or bulk querying, resale, or other use inconsistent with ordinary personal use, we may rate-limit, flag, or suspend an account pending review. Individual queries are also subject to a length limit. These measures target abuse and automation, not ordinary personal use.
7. Affiliate links
Some AI-generated responses in Deeta may include links to external products or services. Where applicable, these links may include affiliate identifiers that result in Deeta earning a commission if you make a purchase. The presence of an affiliate identifier does not affect the price you pay or the AI's recommendation. Deeta never receives information about which contact, deet, or query led to a click.
8. Intellectual property
The Service, including its software, design, and branding, is owned by Deeta and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service under these Terms. These Terms grant you no rights in Deeta's trademarks.
9. Your content
You retain ownership of the information you store in Deeta ("Your Content"). You grant Deeta the limited licence needed to operate the Service for you — for example, to store Your Content on your device, sync it through the paths you enable, and process AI queries you initiate — as described in the Privacy Policy. We do not sell Your Content, and we do not use it to train AI models. You are responsible for Your Content and for having the right to store and share it.
10. Not for healthcare, emergencies, or other sensitive/regulated uses
Deeta is a general-purpose personal-information app. It is not a medical, healthcare, legal, financial, or emergency service, and it is not intended to collect, store, or process protected health information (PHI) or other special-category / regulated sensitive data as a system of record. Deeta is not a HIPAA covered entity or business associate, and the Service is not designed to meet HIPAA, GLBA, or similar regulatory requirements.
You are responsible for the information you choose to enter. Do not use Deeta as the system of record for, or to manage, anything requiring regulated handling — including medical or health records, treatment decisions, or emergency response. Do not rely on Deeta or its AI features in any situation where inaccurate or unavailable information could lead to injury, harm, or legal or financial loss. AI-generated responses are for general convenience only and are not medical, legal, financial, or other professional advice. In an emergency, contact your local emergency services.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. AI-generated responses may be inaccurate or incomplete and are provided for convenience only — do not rely on them as professional advice. We do not warrant that the Service will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent permitted by law, Deeta will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid Deeta in the twelve months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold Deeta harmless from claims and expenses arising out of your misuse of the Service or your violation of these Terms or the rights of others, to the extent permitted by law.
14. Suspension and termination
You may stop using the Service and delete your account at any time (Settings → Account → Delete My Account). We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users — including under the fair-use policy (Section 6). We will give notice where practicable. Sections that by their nature should survive termination (for example, Sections 8–13, 15, and 17) will survive.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we will provide notice (for example, an in-app banner or email) before they take effect. The effective date at the top reflects the most recent version. Continued use after changes take effect means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to the arbitration agreement in Section 17, the courts located in Delaware will have jurisdiction over any dispute not subject to arbitration. Nothing in these Terms limits any consumer-protection rights you have under the law of your country of residence.
17. Dispute resolution; binding arbitration; class-action waiver
Please read this section carefully — it affects how disputes are resolved.
- Informal resolution first. Before starting an arbitration, you and Deeta agree to try to resolve the dispute informally by contacting contact@deeta.app, and to allow 30 days.
- Binding individual arbitration. Except as stated below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, rather than in court, administered under the rules of a recognised arbitration provider. Judgment on the award may be entered in any court of competent jurisdiction.
- Class-action waiver. You and Deeta agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.
- Jury-trial waiver. To the extent a dispute proceeds in court rather than arbitration, you and Deeta each waive any right to a jury trial.
- Carve-outs. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief to protect intellectual-property or security interests. Nothing here waives rights that cannot be waived under applicable law.
- 30-day opt-out. You may opt out of this arbitration agreement and class-action waiver by emailing contact@deeta.app within 30 days of first accepting these Terms; opting out does not affect the rest of the Terms.
